How to search Turkish Insurance Arbitration Commission (Sigorta Tahkim Komisyonu) decisions
Last updated
Short answer: Arbitral decisions of Turkey’s Insurance Arbitration Commission are published in quarterly PDF issues on the Hakem Karar Dergisi (Arbitral Decisions Journal) page of the Commission’s website. The journal page has no decision search field; you open the relevant issue and search inside the PDF. If your AI assistant is connected to Yargı PRO, you can ask it to find the journal issue where your topic appears and to search for decisions by keyword inside an issue.
The journal on the Commission’s website#
The Hakem Karar Dergisi page lists issues from newest to oldest:
| What is there | Detail |
|---|---|
| Issues | Issue 1 covers January-March 2010, issue 67 covers July-September 2026 |
| Period | Each issue covers one calendar quarter |
| Format | Each issue is a single PDF file |
| Search | The page has no decision search field; you open the PDF and search inside it |
If you know the date of the decision, start with the issue for that quarter. The decision you are looking for may not have been published in the journal. The Commission’s menu also has a “Karar Görüntüleme” (view decision) link in the “Tahkim e-İşlemler” (arbitration e-services) section, which opens with an e-Devlet login (Turkey’s e-Government gateway); this link leads to a login screen separate from the journal.
Searching with your AI assistant#
In an AI app connected to Yargı PRO, you can ask in plain language:
- “Find the Hakem Karar Dergisi issues that contain arbitral decisions on diminished value disputes under motor own-damage (kasko) policies.”
- “List the decisions in issue 64 of the Hakem Karar Dergisi that mention ‘değer kaybı’.”
- “Also search for Court of Cassation (Yargıtay) decisions on this topic.”
A topic search returns the journal issue where the topic appears, with a title, a short excerpt and a link; results come back as a single ranked page. A search inside an issue returns every matching decision with its heading (decision date and number), a relevance score and a short excerpt. The first search in an issue can be slow because the PDF is downloaded and converted to text; later searches in the same issue are faster. The decisions are in Turkish; your AI assistant can translate and summarise them for you.
Search inside the journal currently works for issues 1-64; open newer issues on the Commission’s website. Do not put a client’s or any person’s name in your search request; search with legal concepts such as the type of cover or the item of loss.
A real search: diminished value decisions in issue 64#
On 27 October 2026 we used Yargı PRO’s in-journal search tool to search issue 64 of the Hakem Karar Dergisi (October-December 2025), whose number we knew, for the phrase “değer kaybı” (diminished value). We asked for at most five results; the tool returned five decisions. Four of them:
| Decision | Subject of the dispute (from the decision excerpt) |
|---|---|
| 27.10.2025, K-2025/535396 | Diminished value of the applicant’s vehicle in an accident involving a vehicle insured under an extended motor own-damage (kasko) policy; the file had come before the appeal arbitration panel |
| 27.12.2025, K-2025/636551 | Unpaid compensation for vehicle damage and diminution in value in an accident where the driver of a vehicle with compulsory traffic insurance was at fault |
| 25.10.2025, K-2025/532676 | Diminished value compensation from the cover of a compulsory motor third-party liability policy |
| 18.12.2025, K-2025/573874 | Diminished value claim filed at 100 TL as an unquantified claim (belirsiz alacak) |
In this issue, licence plates and earlier decision numbers are masked as “XX” and “XXXX”, so searching with details such as a plate number may return nothing. In the fifth decision, a diminished value claim filed at 10 TL was increased by amendment (ıslah) to 66,274.20 TL after the expert report. These five decisions show that the journal contains decisions from both the dispute arbitrator stage and the appeal arbitration panel (itiraz hakem heyeti) stage; they say nothing about the general trend in diminished value practice.
What to check when reading a decision#
- Legal basis: The Commission was established by Article 30 of Insurance Law No. 5684 (Sigortacılık Kanunu). In a dispute with an insurer that is a member of the system, arbitration is available even without a specific clause in the contract. In disputes arising from compulsory insurance, claimants can use arbitration even if the insurer is not a member.
- Precondition for applying: You must first have applied to the insurer, and the claim must have been rejected in part or in full. You can also apply to the Commission if the insurer gives no written answer within fifteen working days of your application; for traffic insurance this period is fifteen days. A dispute already brought before a court or a consumer arbitration committee (tüketici hakem heyeti) cannot be brought to the Commission.
- Finality and objection: The law treats the arbitral decision as final in disputes below a certain amount. In disputes at or above that amount, an objection can be filed once, before the Commission, within ten days of notification; the appeal arbitration panel hears the objection. In disputes above a higher amount, the decision given on objection can be appealed on points of law (temyiz). Because the amounts in the law can be raised by the administration, check the objection and appeal limits against the amounts in force on the date you filed your dispute application. Reaching the threshold is enough for an objection; for an appeal the relevant limit must be exceeded.
- Appeal in all cases: If the decision is given after the arbitration period has ended, if it rules on something not requested or outside the arbitrator’s authority, or if it fails to rule on the parties’ claims, an appeal is available regardless of the amount.
- Attorney fee: The attorney fee awarded against a party whose claim is rejected in part or in full is one fifth of the fee in the Minimum Attorney Fee Tariff (Avukatlık Asgari Ücret Tarifesi).
- Value as precedent: An arbitral decision binds the parties to the dispute in which it was given. Before relying on a decision as precedent, check the objection and appeal stages; you can also ask the AI app connected to Yargı PRO to search for Court of Cassation decisions on the same topic.
