How to search Turkish Competition Board (Rekabet Kurulu) decisions
Last updated
Short answer: Decisions of the Competition Board (Rekabet Kurulu), the decision-making body of the Turkish Competition Authority (Rekabet Kurumu), are published on the Decisions (Kararlar) page of the Authority’s website. You can search them by title, text, decision type, decision number, decision date and publication date. If your AI assistant is connected to Yargı PRO, you can ask it to search Board decisions and retrieve their texts, and research the related administrative court decisions in the same session.
Searching on the Authority’s website#
The form on the Decisions page offers these fields (the page is in Turkish; field names are given in Turkish in parentheses):
| Field | What it is for |
|---|---|
| Title (Başlık) | Words in the decision’s title; the undertaking’s name and the subject are usually here |
| Text (Metin) | Search in the decision text |
| Decision Type (Karar Türü) | Mergers and Acquisitions, Competition Infringement, Negative Clearance and Exemption, Privatisation, Other |
| Decision Number (Karar Sayısı) | Goes straight to the decision if you know it |
| Decision Date (Karar Tarihi) | The date the Board adopted the decision |
| Publication Date (Yayım Tarihi) | The date the decision was published on the website |
There can be months between the decision date and the publication date. When you follow recent developments, look at the publication date; when you research the Board’s practice in a given period, look at the decision date.
Searching with your AI assistant#
In an AI app connected to Yargı PRO, you can ask in plain language:
- “List the Competition Board’s most recently published decisions of the competition infringement type.”
- “Retrieve Competition Board decision No. 26-06/180-69 and summarise its reasoning.”
- “Search Danıştay 13th Chamber decisions related to this decision.”
A search returns the decision number, the decision and publication dates, the decision type and the title; you ask for the text of the decision separately. For a specific decision, add the decision number to your request and check the record found. Danıştay (Council of State) decisions are searched with the case-law search over the same connection. Check the administrative court, regional administrative court and Danıştay stages separately; an empty search result does not establish that no action was brought.
Decisions are published in Turkish. Your AI assistant reads the Turkish text and can translate and summarise it for you.
A real search: recently published competition infringement decisions#
On 27 October 2026 we searched with Yargı PRO’s tools for decisions of the “Rekabet İhlali” (competition infringement) type, without any other filter. The tool reported 3,629 results in total for this type. The ten most recently published decisions broke down as follows:
| Subject of the decision | Number |
|---|---|
| Ending an investigation for the undertaking concerned after it submitted a settlement text | 5 |
| Reassessment after an annulment decision by the administrative courts | 2 |
| Examination of an alleged infringement under Article 4 of Law No. 4054 | 3 |
Four of the five settlement decisions were adopted on the same day and concern different undertakings in the same investigation in the seedling sector: the Board publishes a separate decision for each undertaking that settles. These ten decisions do not support conclusions about the overall distribution of investigations; but they show that you may come across several decisions from the same investigation in the list.
Three examples:
| Decision number | Decision date | Publication date | Subject |
|---|---|---|---|
| 26-19/572-217 | 21.05.2026 | 22.10.2026 | Ending the investigation in the seedling sector for one undertaking after it submitted a settlement text |
| 26-06/180-69 | 19.02.2026 | 15.10.2026 | Complying with the annulment decision of the regional administrative court, following a reversal decision by the Danıştay 13th Chamber |
| 25-49/1206-681 | 25.12.2025 | 16.10.2026 | Alleged collusion in price offers and in setting the estimated cost in public procurement (Law No. 4054, Article 4) |
These ten decisions show that your research should also cover settlement decisions and Board decisions adopted after annulment judgments.
What to watch for when reading a decision#
- Provision relied on: Check the provision on which the examination is based in the decision’s reasoning. Article 4 of Law No. 4054 on the Protection of Competition (Rekabetin Korunması Hakkında Kanun) governs agreements, concerted practices and decisions of associations of undertakings that restrict competition; Article 6 governs abuse of a dominant position.
- Commitments vs. settlement: In a commitment decision, the process can end without a finding of infringement and without an infringement fine for the competition concern at issue. In a settlement, the undertaking admits the infringement; the decision contains a finding of infringement and a reduced administrative fine. In settlement decisions, examine the scope of the admitted infringement, the reasoning and the fine imposed.
- Judicial review: Board decisions are challenged before the administrative courts; the appeal on points of law (temyiz) stage is before the Danıştay 13th Chamber. In a settlement, the parties that settle cannot challenge the administrative fine or the matters in the settlement text in court. If an annulment decision is given, the Board must comply with it. Before relying on a decision, search for later court decisions.
