How to search Turkish Public Procurement Board (Kamu İhale Kurulu, KİK) decisions
Last updated
Short answer: Decisions of the Public Procurement Board (Kamu İhale Kurulu), the decision-making body of Turkey’s Public Procurement Authority (Kamu İhale Kurumu, KİK), are published on the Authority’s EKAP portal (Electronic Public Procurement Platform), on the Kurul Kararları (Board Decisions) query page. Dispute, regulatory and court decisions are searched as separate types. If your AI assistant is connected to Yargı PRO, you can ask it to search Board decisions by decision text, contracting authority and date range, and to fetch the full text of a decision.
Searching on EKAP#
Board decisions are published in three types: dispute decisions (uyuşmazlık kararları), regulatory decisions (düzenleyici kararlar) and court decisions (mahkeme kararları). Decisions on an “itirazen şikâyet” application (an application for administrative review by the Authority) are among the dispute decisions.
When you open a decision, the following information appears at the top (labels are in Turkish on the site):
| Field | What it tells you |
|---|---|
| Toplantı No and Gündem No (meeting and agenda number) | The Board meeting where the decision was taken and its place on the agenda |
| Karar Tarihi and Karar No (decision date and number) | The reference you will cite (e.g. 2026/UY.II-2658) |
| Mahkeme Kararları (court decisions) | The number of court decisions linked to the Board decision; if there are none, it reads “Bağlı mahkeme kararı bulunmamaktadır” (there is no linked court decision) |
| Başvuruya konu ihale (tender subject to the application) | The tender registration number (İKN) and the name of the tender |
Searching with your AI assistant#
In an AI app connected to Yargı PRO, you can ask in plain language:
- “Search KİK dispute decisions from 2026 on explanations of abnormally low tenders (aşırı düşük teklif açıklaması).”
- “Fetch Board decision No. 2026/UY.II-2658; summarise the claims and the Board’s findings separately.”
- “Search Board decisions concerning the tender with registration number (İKN) 2026/1412389.”
A search returns the decision number, decision date, applicant, the contracting authority and the name of the tender subject to the application. The subject field holds the name of the tender, not the subject of the dispute (abnormally low tender, qualification document and so on); for that, ask for the decision text. The tool returns at most about 500 results per search. If there are too many results, narrow the search by decision type, date range or name of the contracting authority. Results and decision texts are in Turkish; your AI assistant can translate and summarise them for you.
A real search: abnormally low tender disputes#
On 27 October 2026 we searched with Yargı PRO’s tools for the phrase “aşırı düşük teklif” (abnormally low tender) in dispute decisions issued after 1 January 2026. The tool reported 500 results; this is the upper limit the tool can return, so the real number may be higher. The ten most recent decisions shown all belonged to the same Board meeting, held on 14 October 2026. Three of them:
| Decision no | Decision date | Contracting authority | Tender subject to the application |
|---|---|---|---|
| 2026/UY.II-2658 | 14.10.2026 | Nazilli Belediyesi Fen İşleri Müdürlüğü (Nazilli Municipality, Directorate of Technical Works) | Construction of an animal shelter (works contract) |
| 2026/UH.II-2655 | 14.10.2026 | İETT Genel Müdürlüğü (İETT General Directorate) | Maintenance, servicing and repair of passenger lifts and escalators |
| 2026/UM.II-2652 | 14.10.2026 | Artvin İl Tarım ve Orman Müdürlüğü (Artvin Provincial Directorate of Agriculture and Forestry) | Food machinery and equipment (installation included) |
Look at the letters in the decision numbers as well: in the examples we examined, UY was used for works, UH for services and UM for goods; the UY decision whose text we fetched concerned a works contract. The list contained two separate decisions for the same İETT tender (2026/UH.II-2654 and 2026/UH.II-2655); when different bidders apply against the same tender, each application can end in a separate decision. When you research a particular tender, search by its İKN.
In decision 2026/UY.II-2658, whose text we fetched, the Board found that when the contracting authority requested explanations of abnormally low tenders, it had not provided the analysis formats for special and composite (paçal) work items. Without going into the content of the explanations, the Board ordered corrective action (düzeltici işlem) requiring the request to be repeated. The decision states expressly that in such applications the Board first examines the contracting authority’s request for explanations.
What to check when reading a decision#
- Outcome of the decision: Under Article 54(11) of Public Procurement Law No. 4734 (Kamu İhale Kanunu), the Board can reject the application, cancel the tender or order corrective action. In a corrective action decision, check from which stage the contracting authority must repeat its steps.
- Application fee: Under Article 53(j) of the Law, the refund of the part of the objection fee that corresponds to the share of claims found justified depends on the conditions and exceptions in that provision. If a refund has been ordered, apply to the Authority in writing within thirty days following notification of the decision to you. Check whether the operative part of the decision contains an order on the refund.
- Route to the courts: Final Board decisions on “itirazen şikâyet” applications can be challenged before the Ankara administrative courts. The time limit is thirty days from the day after the decision is duly served; the legal basis is Article 57 of Law No. 4734 and Article 20/A of the Law on Administrative Judicial Procedure (İdari Yargılama Usulü Kanunu). For regulatory Board decisions, assess the competent court and the time limit separately.
- Later court decisions: Check the “Mahkeme Kararları” section on the decision page. Before relying on a Board decision, search separately for the administrative court and Council of State (Danıştay) stages; the absence of results in a case-law search does not show that no action was filed.
Which plan?#
